Terms & Conditions ("T&Cs")
By registering and using https://smart.motabilityoperations.co.uk/ (the "Portal"), you accept and agree to these T&Cs which shall be binding.
Password - Subject to registration on the Portal, we undertake to provide you with an individual login for each individual email address registered on the Portal, you shall set-up a unique password security.
Both parties agree and acknowledge that we are entitled to assume that any electronic communication from you via the Portal is bona fide and duly authorised by virtue of the use of password security.
You are responsible for your own the devices, equipment and accounts, software and services needed to use the Portal. We do not guarantee that the Portal will fully function in any particular device or equipment with any particular software and all times. You may only use the Portal with devices or equipment that are owned and/or controlled by you and using only the authorised registered login details and password. You are responsible for keeping your login details and passwords secure and for all activity under the Portal. You must always keep the information accurate. You shall be responsible for complying with these T&Cs.
DISCLAIMER: The portal may include inaccuracies or errors. We provide the Portal as "IS" and without warranties of any kind either expressed or implied. We disclaim all warrantied of suitability and fitness for a particular purpose in relation to the Portal. We do not warrant or make any representation that the Portal will be accurate, reliable, uninterrupted or error-free, that defects will be corrected or that the Portal is free of viruses or other harmful components. You assume total responsibility related to the use of the Portal and any damage or viruses that may infect your systems or equipment as a result of accessing or browsing or downloading any content from the Portal.
The Portal may link to, or allow third party websites, third-party content, social networks or other digital services. This third parties may have their own separate terms and conditions and policies. We are not associated with any of these third parties services and has no responsibility for any loss or damage arising from or related to these third-party content or services.
For the avoidance or doubt, each party acknowledge that each the parties are independent controllers, and one party will regularly disclose to the other party certain personal data (such as customer registration number, agreement registration number and car registration number) for the purpose of the agreement between the parties. Each party shall comply with all the obligations imposed by the applicable legislation as controller.
INDEMINTY: Each party shall indemnify the other against all liabilities, costs, expenses, damages and losses (including but not limited to any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs and all other reasonable professional costs and expenses) suffered or incurred by the indemnified party arising out of or in connection with the breach of the Data Protection Act 2018 and/or UG GDPR by the indemnifying party, its employees or agents, provided that the indemnified party gives to the indemnifier prompt notice of such claim, full information about the circumstances giving rise to it, reasonable assistance in dealing with the claim and sole authority to manage, defend and/or settle it.
We may vary these T&Cs to reflect any changes in our procedures or arrangements via the Portal or where reasonably required by law and we may also vary the information in the Portal. We will not notify you about these changes, therefore, we advise you review these T&Cs and the Portal regularly because such changes will be published on the Portal.
Governing Law – This T&Cs will be governed by and construed in accordance with English Law.
